Two Arrested in North Ave. Construction Site Break-In, Attempted Tool Theft

Police pursued two Ayer men late Sunday night following the break-in.

Weston Police arrested two Ayer men after they were found attempting to steal power tools from a North Avenue construction site late Sunday night.

Kyle Shepard, 23, and Gilson Batres, 30, both of 85 Groton School Road, Ayer were arraigned Monday on charges of breaking and entering in the nighttime, destruction of property, possession of burglarious instruments and trespassing in Waltham District Court, according to a press statement issued by Lt. Danny Maguire of the Weston Police Department.

Police received a call at about 11:30 p.m. Sunday, Sept. 30 from a resident who reported an in-progress break-in at a construction site at 560 North Ave.

Police responded to the scene and apprehended Shepard while other officers pursued a second suspect through the woods in the area.

Police from Weston, Lincoln and Waltham set up a perimeter in the area and eventually saw a vehicle registered in Ayer pick someone up. Police later pulled the vehicle over and found Batres hiding in the trunk "cold, wet and shoeless," according to the statement. Batres was placed under arrest.

The driver, Batres’ nephew, was not charged because police believed he was unaware of Batres’ involvement in the break in, according to the press statement.

Police noticed that the lock on a trailer at the site was cut with bolt cutters and discovered numerous power tools piled up in the site's driveway. There was also a vehicle registered to Shepard and Batres’ address backed up in the driveway, according to the statement.

Police estimate the value of the tools taken to be “substantial.” Global Hill Construction Co. is the contracting service at the site.

Good job Weston Police! Being in the industry and having been burglarized and vandalized before, it is wonderful to hear of this arrest.
