Regis College Files Suit Against Weston

The suit involves the campus' plans to expand.

Regis College has filed suit against the town of Weston, regarding its senior housing project Regis East, in both the Appeals and Supreme Judicial Courts.

The suit is in response to the Weston Zoning Board of Appeal's rejection in 2009 of the college's proposed expansion plans. The Boston Globe reported that the plan was rejected under the so-called Dover Amendment (Massachusetts General Law, Chapter 30A, Section 3), which allows churches and schools to bypass local zoning bylaws.

The Weston ZBA ruled at the time that Regis did not qualify under the Dover Amendment.

The suit went onto the Land Court, which ruled against Regis last year.

According to the Boston Business Journal, which received a press release, "Regis has asked the SJC to reaffirm the court’s interpretation of the Dover Amendment, to clarify its definition of educational purposes and to affirm the value of intergenerational educational settings."
